Welcome to LeMS. These Terms and Conditions (“Terms”) govern your use of our mobile applications and services related to fixed-battery electric vehicle charging. By downloading, accessing, or using our app, you agree to comply with these Terms. If you do not agree, you must not use our services.

1. Acceptance of Terms

By accessing or using LeMS services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any applicable service guidelines.

2. User Accounts

·      Users must register with accurate, complete, and current information.

·      You are responsible for maintaining the confidentiality of your login credentials.

·      You are responsible for all activity conducted under your account.

·      LeMS may suspend or terminate accounts if fraudulent, unauthorized, or abusive activity is detected.

3. Payments and Charging Fees

·      Payments are required for battery rental and charging sessions, calculated based on kWh of energy consumed.

·      Charges will be automatically billed to your account for each charging session.

·      Refunds, if applicable, will be credited directly to your e-pouch only.

4. Intellectual Property

·      All content, software, logos, designs, and documentation are the property of LeMS and protected by intellectual property laws.

·      You may not copy, distribute, or create derivative works without prior written permission.

5. Prohibited Activities

You agree not to:

·      Attempt unauthorized access to LeMS systems or other users’ accounts.

·      Interfere with the normal operation of the service.

·      Use the app for illegal, harmful, or fraudulent purposes.

Violation of these rules may result in suspension, termination, or legal action.

6. Service Use and Safety

·      Users are responsible for ensuring that any third-party chargers they use are compatible with their vehicles.

·      LeMS is not responsible for any damage to the vehicle, battery, or property resulting from the use of third-party chargers.

·      The app provides usage dashboards, including monthly summaries, carbon savings, and expenditure. These metrics are for informational purposes only and are not guaranteed.

7. Data Collection and Privacy

Your use of LeMS services is governed by our Privacy Policy, which explains the collection, use, and storage of personal, battery, and charging-related data. By using the service, you consent to these practices.

8. Limitations of Liability

·      LeMS provides services “as is” and does not guarantee uninterrupted or error-free service.

·      We are not liable for indirect, incidental, or consequential damages, including loss of data, vehicle issues, or billing errors.

9. Refunds

·      Refunds for any overcharges or failed transactions will be credited directly to your e-pouch.

·      Refund requests can be submitted via support@lems.lk.

·      Refunds will be processed within 15 working days after verification.

10. Modifications

LeMS may update these Terms at any time. Changes will be effective upon posting in the app or website. Continued use of the service constitutes acceptance of the updated Terms.

11. Termination

·      LeMS may suspend or terminate your access for violations of these Terms or for operational reasons.

·      Upon termination, your account and access to services will be disabled, but any retained data required for legal compliance may remain stored.

12. Governing Law

These Terms are governed by the laws of Sri Lanka, without regard to conflict of law provisions. Any disputes will be resolved in the courts of Sri Lanka.
